FMLA Pregnancy Discrimination

This website is full of advertisements
and hard to follow, but discusses FMLA
changes that are worth reading. I can't
seem to link to this page without
referring back to the first page and more
advertisements. At any rate, this is a
link and has much more information under
the big advertisements at the top.

"For the past 15 years, complying with the
FMLA has been complex, but at least the
law stayed the same. On Jan. 16, that all
changed. That's the day the first major
overhaul of the FMLA took effect. Here are
the details: FMLA Intermittent Leave:
5 Guidelines on managing intermittent
leave and curbing leave abuse under the new
FMLA regulations."

The Kinston-based Britthaven nursing home and
assisted-living chain has settled a pregnancy
discrimination claim with the EEOC for
$300,000. The agreement settles a lawsuit
brought by Katherine Hance and other pregnant
employees who claimed they were treated
differently from other employees because the
company required them to obtain full medical
clearance as soon as it learned they were
pregnant. As a result, even though the women
were still capable of performing their jobs,
they were forced to take leave or be
terminated. Advice: Take a close look at any
policy that singles out pregnant women.

Most likely, it violates the law.
